What is "Prop 65"?
"Prop 65" refers to California's Safe Drinking Water and Toxic Enforcement Act of 1986, commonly known as Proposition 65. This law requires businesses to provide warnings if their products expose Californians to any of over 900 chemicals that are known to pose certain health risks, including lead.
Products sold in California that may exceed the levels established under Prop 65 must include a warning label. For lead, the Prop 65 limit is 0.5 micrograms per daily serving, unless higher levels are deemed naturally occurring.
To put this into context: many everyday foods — including fruits, vegetables, grains, nuts, and even drinking water — naturally contain levels of lead above 0.5 micrograms. Healthy foods such as turnips, apples, artichokes, carrots, cucumbers, green beans, spinach, brown rice, almonds, and other nuts often contain lead at levels considerably higher than the Prop 65 limit.
Why is this? Plants naturally absorb trace elements, including metals, from the soil in which they grow. Detectable levels of lead do not mean the soil is contaminated or that the plants are unsafe. Whether the soil is certified organic or conventional, and whether the crop is organic or genetically modified, trace amounts of lead are naturally present in most produce — often above Prop 65's limit of 0.5 micrograms.
In fact, studies conducted by the State of California on soil from 70 locations found that vegetables typically contain four times the lead limit set by Prop 65. However, you won't see Prop 65 warning labels on fresh produce because these levels are legally recognized as naturally occurring.
